1. Agreement to Terms

By accessing or using the services provided by PipelinePilot Solutions Inc. ("we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, then you may not access our services.

2. Covered Services

These Terms of Service apply to all services provided by PipelinePilot, including but not limited to:

  • PipelinePilot website (pipelinepilot.dev)
  • AI-powered lead automation services for real estate professionals
  • SMS/text messaging communications

By using any of our services, you agree to be bound by these Terms of Service.

3. Description of Services

PipelinePilot provides AI-powered lead automation services for real estate professionals, including but not limited to automated lead response, lead qualification, pipeline segmentation, nurture campaigns, appointment booking, CRM integrations, SMS/text messaging communications, and related services.

4. SMS/Text Messaging Program

PipelinePilot offers an SMS/text messaging program as part of our services. By opting in to receive text messages from PipelinePilot, you agree to the following:

  • Program Description: Our SMS program may include account notifications, appointment reminders, service updates, and other non-promotional communications related to PipelinePilot services.
  • Message Frequency: Message frequency varies based on your interaction with our services and the specific programs you are enrolled in.
  • Message and Data Rates: Message and data rates may apply. Please contact your mobile carrier for details about your text messaging plan and any charges that may apply.
  • Opt-Out: You may opt out of receiving text messages at any time by replying STOP to any message you receive from us. After opting out, you will receive a one-time confirmation message and will no longer receive SMS messages unless you opt in again.
  • Help: For support, reply HELP to any message or contact us at pipelinepilot.co@gmail.com.
  • Supported Carriers: Our SMS services are supported by major U.S. carriers. Carriers are not liable for delayed or undelivered messages.
  • Consent Not Required for Purchase: Consent to receive SMS messages is not a condition of purchasing any goods or services from PipelinePilot.

5. Carrier Liability Disclaimer

PipelinePilot and mobile carriers (including but not limited to T-Mobile, AT&T, Verizon, and others) are not liable for delayed or undelivered messages. Delivery of messages is subject to effective transmission from your network operator and is outside of our control. T-Mobile is not liable for delayed or undelivered messages.

6. User Responsibilities

You are responsible for maintaining the confidentiality of your account credentials. You agree to use the services in compliance with all applicable laws and regulations, including real estate communication regulations such as CAN-SPAM and TCPA. You agree not to:

  • Violate any applicable laws or regulations
  • Infringe upon the rights of others
  • Transmit any harmful, offensive, or illegal content
  • Interfere with or disrupt our services or servers
  • Attempt to gain unauthorized access to our systems
  • Use automated systems to access our services without permission

7. Payment Terms

Pricing and payment terms will be discussed during your strategy call and outlined in a separate service agreement. All fees are non-refundable unless otherwise stated or required by law. We reserve the right to change our pricing at any time, but changes will not affect purchases already made.

8. Intellectual Property

All content, features, and functionality of PipelinePilot are owned by PipelinePilot Solutions Inc. and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise exploit any of our content without our prior written permission.

9. Limitation of Liability

To the maximum extent permitted by law, PipelinePilot shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of our services. This includes, without limitation, any damages arising from the use or inability to use our SMS/text messaging services, delayed or undelivered messages, or any errors in message content.

10. Age Restriction

You must be at least 18 years of age to use our services, including our SMS/text messaging program. By using our services, you represent and warrant that you are at least 18 years old. If we learn that we have collected information from a person under 18, we will promptly delete that information.

11. Privacy Policy

Your use of our services is also governed by our Privacy Policy, which describes how we collect, use, and protect your information, including information related to our SMS/text messaging program. You can review our Privacy Policy at pipelinepilot.dev/privacy.

12. Termination

We may terminate or suspend your access to our services immediately, without prior notice, for any reason, including if you breach these Terms. Upon termination, your right to use our services will cease immediately.

13. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect. Your continued use of our services after any changes constitutes acceptance of the new Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which PipelinePilot Solutions Inc. operates, without regard to its conflict of law provisions.
